Important information for parents and guardians about accident claims for children.
Children have special protection under Irish law. Whilst adults have 2 years to make a claim, the statute of limitations for children doesn't begin until they turn 18. This means a child can make a claim up until their 20th birthday. However, parents can (and often should) make claims on behalf of their children much sooner whilst evidence is fresh and witnesses are available.
A parent or legal guardian can make a claim on behalf of a child under 18. This person acts as the child's "next friend" in legal proceedings.
All settlements for children must be approved by the court. The court will determine how the money should be managed - often it's held in a special court fund until the child turns 18, though the court may allow payments for the child's benefit, such as medical treatment, education, or special needs.
In most cases, children don't need to attend court. The vast majority of cases are settled without a full trial. If court approval is needed for a settlement, usually only the parent/guardian needs to attend. We always prioritise minimising stress and disruption to your child.
Yes, claims can still succeed even if there was some contributory negligence. Courts recognise that children don't have the same judgement as adults and make allowances for their age and understanding. The compensation may be reduced proportionally, but the child's age is always considered when assessing fault.
Compensation can cover: medical expenses (past and future), rehabilitation costs, special educational needs, psychological support, care costs, adaptations to home/school, loss of future earnings potential, and pain and suffering. We ensure all current and future needs are considered.
No, you will not have to pay to bring a claim for compensation. In accordance with Section 68 of the Solicitors Act 1994, "A solicitor shall not act for a client in connection with any contentious business on the basis that all or any part of the charges to the client are to be calculated as a specified percentage or proportion of any damages or other moneys that may be or may become payable to the client."
